General Terms and Conditions
Summary
These General Terms and Conditions (GTC) apply to all services provided by the Hotel and govern the conclusion of contracts, prices and payment terms (including VAT adjustments, advance payments/security deposits and default interest), as well as the provision, use and return of rooms.
Detailed cancellation and withdrawal regulations are defined for individual and group reservations, trade fair periods and events. In the event of non-compliance, flat-rate charges of up to 100% may apply depending on the booked rate and deadline. The Hotel is also entitled to withdraw under certain conditions.
Provisions regarding participant numbers, external food and beverages, technical equipment, copyright and artists’ social security contributions, decoration/exhibits and liability regulate the customer’s obligations and cost risks.
The Hotel’s liability is limited by law. Defects must be reported immediately. German law applies. Place of performance and jurisdiction is the registered office of the Hotel. Amendments must be made in writing.
Scope
These General Terms and Conditions apply to all services and deliveries of the Hotel.
If the Hotel amends its General Terms and Conditions before the end of the contract, the amended version shall become part of the contract if the contractual partner is notified in writing with reference to these legal consequences and does not object within 14 days.
The customer’s general terms and conditions shall only become part of the contract if the Hotel expressly agrees to their inclusion in writing.
Conclusion of Contract
The contract (hereinafter also referred to as “Booking”) is concluded upon the customer’s request through acceptance by the Hotel. The Hotel is free to confirm the booking in writing.
If a third party makes the booking on behalf of the customer, the third party shall be jointly and severally liable with the customer.
Services, Prices, Payment, Set-Off
The Hotel is obliged to provide the services ordered by the customer and confirmed by the Hotel.
The customer is obliged to pay the agreed prices for these services and for any additional services used. This also applies to services and expenses incurred by the Hotel towards third parties at the customer’s request.
In the event of justified withdrawal by the Hotel, the customer shall have no claim for damages.
The agreed prices include statutory VAT (currently 7% for accommodation services and 19% for other services). If VAT changes after contract conclusion, prices shall be adjusted accordingly.
If more than four months elapse between contract conclusion and performance and the Hotel’s generally applicable prices increase, the Hotel may increase the contractually agreed price by up to 5%.
The Hotel may also increase prices if municipal charges (e.g., cultural tax, visitor’s tax) are introduced; such increase is limited to the actual amount of such charges.
Unless otherwise agreed, invoices are payable within 7 days without deduction. The Hotel may declare accrued claims due at any time. In case of default, interest shall be charged at 10 percentage points above the base interest rate for entrepreneurs and 5 percentage points above for consumers. The Hotel reserves the right to prove higher damages.
Subletting or re-letting of rooms or other premises requires prior written consent of the Hotel.
The Hotel may request reasonable advance payments or security (e.g., credit card guarantee) upon conclusion of the contract. Failure to provide such payment entitles the Hotel to withdraw and claim damages.
The customer may only offset undisputed or legally established claims.
Room Provision, Handover and Return
The customer has no entitlement to a specific room unless confirmed in writing.
Rooms are available from 3:00 p.m. on arrival day. The Hotel may re-let rooms after 6:00 p.m. unless late arrival has been communicated.
Rooms must be vacated by 11:00 a.m. on departure day. Late departure:
Until 6:00 p.m.: 80% of room rate
After 6:00 p.m.: 100% of room rate
Rooms are provided exclusively for accommodation purposes.
Pets require prior consent and may incur additional charges.
The customer is liable for damages caused by themselves or third parties attributable to them.
Loss of room key card: €2.50 fee.
Strict non-smoking policy throughout the Hotel (including at open windows). Violation: €250 special cleaning fee plus compensation for lost revenue if re-letting is impossible.
Tampering with smoke detectors is a criminal offense. Resulting costs (e.g., fire brigade deployment) will be charged to the guest.
Cancellation by the Customer – Accommodation Contract
Written consent of the Hotel is required unless cancellation conditions apply according to the booked rate.
Individual Reservations (up to 5 rooms)
Flexible Rate
Free cancellation until 6:00 p.m. on arrival day. After that or in case of no-show: 100% of first night.
Trade Fair Rate
Free cancellation until 7 days before arrival. After that or no-show: 100% of first night.
Non-Refundable Rate
No free cancellation. 100% of entire stay charged.
If a guest fails to arrive on the first day of a multi-day booking without prior consultation, the Hotel may re-let the room.

Withdrawal by the Hotel
The Hotel may withdraw if:
Advance payment not made
Force majeure
Misleading information
Threat to business, safety, reputation
Illegal purpose
Unauthorized subletting
Hotel closure or renovation
Insolvency proceedings
No damages claim by the customer in justified withdrawal.
Liability
The Hotel is liable with the care of a prudent merchant.
Liability exclusions apply except for:
Injury to life, body or health
Intent or gross negligence
Breach of essential contractual obligations
Statutory liability for brought-in property (§§ 701 ff. German Civil Code) remains unaffected.
Claims lapse after one year (five years for damages independent of knowledge).
Final Provisions
Amendments must be made in writing.
Place of performance and jurisdiction: registered office of the Hotel.
German law applies. CISG excluded.
